Brown Law Amendments Authorized by Governor Newsom in Response to Covid-19
Governor Newsom signed Executive Order N-29-20 which replaces Executive Order N-25-20 as this order relates to Brown’s Law (the order can be viewed here). Executive Decree N-29-20 further addresses concerns from public health officials and public agencies that complying with open meeting laws could accelerate the spread of the COVID-19 virus. The new executive order no longer requires public agencies subject to Brown’s Law to have a physical location open to the public to observe and speak at the meeting. Agencies are now permitted to allow the public to observe and address the meeting by telephone or electronically.
The following provisions are the main provisions of the executive decree with the substantial modifications compared to the previous decree identified in bold below:
- Allows public bodies to hold public meetings by teleconference and make the meeting accessible electronically or by telephone to all members of the public wishing to attend and address Council.
- The requirement that each teleconference location be accessible to the public is suspended.
- The requirement to post agendas at all conference locations and to note each location from which the member is calling is suspended.
- The requirement of at least the quorum within the limits of the jurisdiction is suspended.
- Notice must always be given 72 hours in advance for regular meetings and 24 hours in advance for special meetings.
- Local agencies can organize meetings by teleconference and allow the public to observe and address the meeting by telephone or electronically. (NOTE: The prior order required that at least one physical location be open to the public to observe and address the meeting. A physical location to observe the meeting is no longer required.)
- If the meeting is held by telephone or electronically, agencies should implement a process to receive and promptly resolve requests for reasonable modification or accommodation from persons with disabilities, in accordance with the ADA. The procedure must be announced each time a notice of meeting is given.
- Agencies are encouraged to use good judgment and make reasonable efforts to comply as much as possible with Brown’s Law.

Approval of the consent schedule
The consent schedule includes routine financial and administrative actions that are usually approved by a single majority vote. There will be no discussion of these items prior to the vote on the motion, unless Commission members or the public request that specific items be discussed and / or removed from the consent timeline.
Any member of the audience wishing to address the Commission on a matter on the agenda:
Members of the public are invited to join this meeting via the Zoom teleconference. To ensure that all interested parties have a chance to have their say, please be brief and limit your comments to the topic under discussion. Each person usually has 3 minutes to speak; time limits are at the discretion of the President.
While members of the public are invited to address the Commission, under Brown’s Act, Commission members cannot deliberate or take action on items not on the agenda, and usually can only listen.
Commitment to civic engagement
All are encouraged to engage in a respectful dialogue that supports freedom of expression and values diversity of opinion. Commissioners, staff and the public are encouraged to:
- Create an atmosphere of respect and civility where commissioners, county staff and the public are free to express their ideas within the parameters of time and content established by the Brown Act and the RSCs standard parliamentary procedures (Robert’s Rules of Order);
- Establish and maintain a cordial and respectful atmosphere during discussions;
- Foster a constructive dialogue free from attacks of a personal nature and / or attacks based on age, (disability), class, level of education, sex, gender identity, profession, race and / or ethnic origin, sexual orientation;
- Listen with an open mind to all information, including divergent points of view, concerning the issues presented to the Commission;
- Recognize that it is sometimes difficult to speak in meetings and, out of respect for everyone’s point of view, allow speakers to speak without comments or bodily gestures, including boos, whistles or applause;
